Use of the Site

The User is fully and solely responsible for all content or information you may submit to the Hôpitaux Robert Schuman on or through the Site.

Intellectual property

Hôpitaux Robert Schuman own or possess or keep all the intellectual property related to the Site, in particular but not limited to the marks, trade names and rights pertaining to the databases, procedures, software, patents, copyright, drawings, logos, calculations, algorithms and domain names. Hôpitaux Robert Schuman reserve all rights attached to the intellectual property described above.

All materials relating or linked directly or indirectly to the Site is the property of Hôpitaux Robert Schuman and are protected by copyright, trademark rights and other laws in force.

The following elements, among others, are the exclusive property of Hôpitaux Robert Schuman: the trademarks, service marks and logos of Hôpitaux Robert Schuman including all other content and material including the names, images, logos, software, text, graphics, data, prices, changes, tables, video and audio data of any type or format, which pertains to or identifies Hôpitaux Robert Schuman in any form whatsoever (e.g. text, graphics, images, audio-video material, html code, tabs, marks, software or logos, hereinafter “HRS Marks”).

Exclusion of liability

To the broadest extent permitted by law, Hôpitaux Robert Schuman declines all responsibility for any loss or damage resulting from a decision taken by Hôpitaux Robert Schuman pursuant to the above paragraph “Termination and suspension”.

In all cases, the total amount of damages and interest due from Hôpitaux Robert Schuman in relation to the events resulting from or connected to the Site or the Services on the Site, whether based on contractual or tortious liability or other, shall be limited to the sum of 1000 euros.

To the broadest extent permitted by law, Hôpitaux Robert Schuman declines all liability in the event that we are unable to provide the Services on the Site for reasons beyond our control, including but not limited to cases of force majeure or changes in the law.

Compensation

Applicable law and jurisdiction

Unless expressly stated otherwise by Hôpitaux Robert Schuman, no omission or delay by Hôpitaux Robert Schuman in exercising any rights or recourse under this Notice may be considered a waiver of such rights or recourse, or of any other right or recourse available under the Notice.

Any waiver by Hôpitaux Robert Schuman shall only be valid if given in writing.

All communications given by or to Hôpitaux Robert Schuman and all communications made by or sent to you in relation to the Site, the Services on the Site or the Notice, must be made via the messaging system available on the Site, or by sending an e-mail to service.communication@hopitauxschuman.lu. Such notices will be considered equivalent to printed documents, also for evidence purposes.

The User and Hôpitaux Robert Schuman may however send communications by hand, by post or by courier. In such a case, any notice sent to Hôpitaux Robert Schuman must be sent to the address below, or to any other address provided from time to time by Hôpitaux Robert Schuman:

Hôpitaux Robert Schuman is required to send all communications to the e-mail or postal address provided to Hôpitaux Robert Schuman. Access to and use of the Site, the Services on the Site, the Notice and the processing of your personal data by Hôpitaux Robert Schuman are governed by the laws of the Grand Duchy of Luxembourg, with the exclusion (where permitted by law) of all provisions of the private international law of Luxembourg or any legal provision that would result in application of the laws of a different jurisdiction. This is without prejudice to the protection assured by mandatory rules of law which would apply in the absence of this paragraph.

The provisions of the above paragraph also apply to any disputes concerning crimes related to the Site or the Services on the Site.

Any dispute relating to the access to and use of the Site or the Services on the Site or directly or indirectly linked to the Notice, shall fall under the exclusive jurisdiction of the courts and tribunals of Luxembourg City (Grand Duchy of Luxembourg).
